Welcome. This page explains the ground rules for using stratmanlawfirm.com. We've kept it as readable as we could without sacrificing what it needs to say, but it's still a binding agreement, so please take a few minutes with it.
A few things up front:
- This website is informational. It is not legal advice. Reading our content, contacting us through a form, or downloading a resource does not create an attorney-client relationship between you and Stratman Law Firm. That relationship only forms after we've run a conflict check, signed an engagement letter, and confirmed in writing that we represent you.
- By using this site, you're agreeing to these Terms. If you don't agree with any part of them, please don't use the site.
- This page may change. When it does, the "Last Updated" date at the top will reflect it. Continuing to use the site after a change means you accept the new version.
If anything here is unclear, email [email protected] and we'll do our best to clarify.
These Terms of Use ("Terms") govern your access to and use of stratmanlawfirm.com and any related pages, forms, content, or services we make available through it (together, the "Site").
The Site is operated by Stratman Law Firm, PLLC, doing business as Stratman Law Firm, an Arizona professional limited liability company ("Stratman," "we," "us," or "our"). When we refer to "you," we mean any person who accesses or uses the Site.
By accessing or using the Site, you confirm that you are at least 18 years old, that you have the authority to agree to these Terms (on your own behalf or on behalf of any entity you represent), and that you accept them in full.
This is the most important section on the page, so we're putting it near the top.
Everything published on stratmanlawfirm.com, including practice area pages, blog articles, FAQs, attorney bios, downloadable resources, and general commentary on Arizona HOA and real estate law, is provided for general informational purposes only. It is not legal advice and should not be relied on as a substitute for advice from a licensed attorney familiar with the specific facts of your situation.
Arizona law and federal law change. Court decisions reshape how statutes are applied. Your community's CC&Rs, your contract, your transaction, and your circumstances are unique. A blog post cannot account for any of that. Only an actual consultation can.
No attorney-client relationship is created by:
- Visiting or reading content on the Site
- Submitting a contact form, requesting a consultation, or sending us an email
- Following Stratman or any of our attorneys on social media
- Downloading a resource, signing up for our newsletter, or attending a webinar we host
An attorney-client relationship with Stratman is formed only when (a) we have conducted a conflict check, (b) you and Stratman have signed a written engagement letter, and (c) we have confirmed the engagement in writing. Until all three happen, nothing you send us is protected by the attorney-client privilege, and we owe you no duty of confidentiality. Please do not send confidential or time-sensitive information through this Site unless and until we have a signed engagement.
This Site constitutes attorney advertising under the Arizona Rules of Professional Conduct. Content on the Site is intended to inform potential clients about Stratman's services. Results described in any case study, testimonial, or commentary depend on the specific facts and law of each matter and do not guarantee or predict a similar outcome in any other matter. Past performance is not a guarantee of future results.
For our full attorney advertising disclosure, see our Attorney Advertising Disclaimer.
You're welcome to read, print, and share our content for personal, non-commercial purposes. For example, sending a blog post to a fellow board member, or printing an FAQ for your records. That's what it's there for.
You agree not to:
- Use the Site or its content for any commercial purpose without our written permission, including republishing our articles, selling our content, or repackaging it for a competing service
- Copy, scrape, mine, or harvest content from the Site using automated tools, bots, or similar methods
- Reverse engineer, decompile, or attempt to extract source code from the Site
Interfere with the Site's operation, security, or availability, or attempt to access areas of the Site you are not authorized to access
- Upload viruses, malicious code, or anything intended to disrupt the Site or its users
- Use the Site to harass, defame, or violate the rights of any other person
- Misrepresent your identity, impersonate any Stratman attorney or staff member, or imply an affiliation with the firm that does not exist
- Use the Site in any way that violates Arizona, federal, or any other applicable law
We may suspend or terminate your access to the Site at any time, for any reason, without notice.
All content on the Site, including text, graphics, logos, photography, video, audio, the Stratman wordmark and logo system, the site design and layout, and the underlying code, is owned by Stratman or our licensors and is protected by U.S. copyright, trademark, and other intellectual property laws.
"Stratman," "Stratman Law Firm," our logo, and any related marks are trademarks of Stratman Law Firm, PLLC. You may not use them without our prior written permission.
Nothing on this Site grants you any license to any Stratman intellectual property, by implication or otherwise, except for the limited right to view and personally use the Site as described in Section 4.
If you submit information to us through a contact form, consultation request, newsletter signup, application form, or any other input on the Site (collectively, "Submitted Information"), you agree that:
- The information you provide is accurate and current to the best of your knowledge
- You have the right to share that information with us
- You will not submit information that belongs to someone else without their permission, and you will not submit information that is confidential, privileged, or subject to a non-disclosure obligation owed to a third party
- You understand that, until we have an engagement letter in place, the information you submit is not protected by the attorney-client privilege and may not be treated as confidential (see Section 2)
We will handle Submitted Information in accordance with our Privacy Policy.
If you submit feedback, suggestions, or ideas about the Site or our services, you grant us a perpetual, royalty-free, worldwide license to use that feedback without obligation or compensation to you.
The Site may link to third-party websites, resources, payment processors (including LawPay), or services that we don't own or control. We provide these links for convenience. We don't endorse, vouch for, or take responsibility for the content, accuracy, privacy practices, or business practices of any third party. Visiting a linked site is at your own risk and subject to that site's own terms and policies.
If you make a payment to Stratman through the Site, that transaction is processed by a third-party payment processor (LawPay) under its own terms. Stratman does not store your full payment card information. By initiating a payment, you authorize the charge in the amount shown and confirm that you have the legal authority to use the payment method provided.
We do our best to keep the Site accurate, current, and available, but we can't guarantee any of that. The Site and all content on it are provided "as is" and "as available," without warranties of any kind, express or implied. To the fullest extent permitted by law, Stratman disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of content.
We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
To the fullest extent permitted by Arizona law, Stratman, its members, attorneys, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, business interruption, or reputational harm, arising out of or related to your use of the Site, even if we have been advised of the possibility of such damages.
Our total aggregate liability arising out of or related to the Site, regardless of the legal theory, will not exceed one hundred U.S. dollars ($100.00).
Nothing in this section limits any liability that cannot be limited under Arizona law, including any duty Stratman owes to a client under an executed engagement letter, which is governed by that engagement letter and not by these Terms.
You agree to indemnify and hold harmless Stratman, its members, attorneys, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of (a) your use of the Site, (b) your breach of these Terms, (c) your violation of any law or the rights of any third party, or (d) any information you submit through the Site.
These Terms, and any dispute arising out of or related to them or the Site, are governed by the laws of the State of Arizona, without regard to its conflict-of-law principles.
You and Stratman agree that the exclusive venue for any dispute arising out of or related to these Terms or the Site will be the state and federal courts located in Maricopa County, Arizona. You consent to the personal jurisdiction of those courts and waive any objection based on venue or forum non conveniens.
If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the rest of the Terms will remain in full effect. These Terms, together with our Privacy Policy and any other policies referenced here, constitute the entire agreement between you and Stratman regarding the Site, and supersede any prior agreements on the same subject.
